These terms are the agreement between you and Tomatograph, operated by Mantas Ratomskis (“we”). They cover the Tomatograph website and iOS app. By creating an account you agree to them. If you don't agree, please don't use the service.
Tomatograph tracks what your household grows and generates care suggestions from local weather, frost dates, hardiness zone, and what you've planted. It also offers optional AI-assisted plant identification and health checks from photos you submit.
This matters, so it's near the top. Everything Tomatograph tells you — task reminders, weather-driven warnings, AI garden reviews, plant identifications, and health assessments — is informational guidance generated automatically. It is not professional horticultural, agricultural, or safety advice, and it can be wrong.
You are responsible for decisions you make about your own garden.
You need to be at least 13 (16 in the EEA) to use Tomatograph. Keep your Apple or Google sign-in secure — activity under your account is your responsibility. Give us accurate information and keep it current.
Anyone you invite into your household can see and modify that household's gardens, plants, photos, and task history, and can see who completed which task. Invite carefully. If you're invited into someone else's household, respect their content.
Photos and text you add stay yours. You grant us a limited licence to store, process, and display that content solely to operate the service for you — including sending photos to the third-party services named in our Privacy Policy when you request an identification or health check. We don't use your content to train AI models, and we don't publish it.
You confirm you have the right to upload what you upload, and that it isn't unlawful, infringing, or someone else's private information.
Every household gets a free plan, permanently: one garden, one plant, and five AI health checks per month. Structures (vegetable beds, greenhouses, lawn) are never limited. A paid subscription (€4.99/month or €49/year) removes the garden and plant limits and raises the health-check allowance to 60 per month. Your existing gardens, history, and data remain visible and exportable on the free plan — we don't lock you out of what you've already recorded.
Subscriptions are purchased in the iOS app, billed through your Apple ID, and renew automatically unless you turn off auto-renew at least 24 hours before the period ends. Your account is charged for renewal within 24 hours of the end of the current period. Manage or cancel a subscription in your device's Settings → Apple ID → Subscriptions; deleting the app does not cancel it.
Purchases made through Apple are subject to Apple's terms, and refunds are handled by Apple, not by us. Prices may change; we'll give notice before a change affects a renewal.
Please don't:
Tomatograph is provided as-is. We're a small operation: there may be downtime, bugs, or changes to features, and third-party services we depend on (weather, AI, identification) can fail or change independently of us. We don't guarantee uninterrupted or error-free service.
You can stop using Tomatograph at any time and request deletion of your account by emailing grow@tomatograph.com. We may suspend or terminate an account that materially breaches these terms; where it's reasonable to do so, we'll warn you first.
To the fullest extent the law allows, Tomatograph is provided without warranties of any kind, and we aren't liable for indirect or consequential losses, lost crops, lost profits, or lost data. Where liability can't be excluded, it's limited to the amount you paid us in the 12 months before the claim.
Nothing here excludes liability that can't legally be excluded — including your statutory consumer rights, which these terms don't take away.
These terms are governed by the laws of Lithuania, and disputes fall to the courts of Lithuania. If you're a consumer elsewhere in the EU, you keep the protection of your home country's mandatory consumer law.
We may update these terms. Material changes will be reflected in the date at the top and, where significant, notified in the app or by email. Continuing to use Tomatograph after a change means you accept the updated terms.
